In Portugal, the law obliges real estate agents to enter into a «real estate mediation contract» and to obtain documentation relating to the property. To ensure that the sale of your property proceeds unhindered, we will examine your documentation to ensure that everything is legal.

To sell your property, you must provide copies of the following documents :

– Citizen card and NIF

– Building Register (Caderneta Predial)

– Certificate of Land Registry (Certidão do Registo Predial)

– Licence (or exemption for accommodation prior to 1951)

– Energy certificate

– Housing data sheet (applicable to housing after 2004)

– Plans if you have

Costs of selling a property in Portugal

The seller is responsible for paying the expenses of selling the property to the real estate agent. It is also obliged to pay the added value that will be higher if the seller is not a Portuguese tax resident. If you are a Portuguese taxpayer, you will benefit from an exemption of 50% of the 25% of the capital gains tax (i.e., 12.5%).

How do we proceed ?

As said before, in Portugal agency fees are borne by the seller and our commission is 5% + VAT like most agencies.

Exclusivity regime or open contract

It is not uncommon to register your property with several agencies in Portugal, but know that real estate agents often use the same marketing platforms as your home and this can be frustrating for a buyer who sees your property advertised everywhere. In addition to being confusing to the buyer, it can also send the wrong message. An exclusive mandate can allow you to negotiate fees with the agent responsible for your home and access to your property for visits can be better controlled. This decision depends entirely on you.

  • Signature in the notary

    In the sale commitment, there is a fixed date for the signing of the «Public Deed» (authentic act of purchase). In general, it is 2 to 12 weeks after signing the CPCV (sales commitment).

    After signing, the authentic document and the property are registered in the Land Registry, the legal transfer occurred: you are the owner of your dream home! Attention: your lawyer must register this transfer in the register.
    After the transfer of ownership has taken place, the change of ownership must also be transferred to the electricity supplier, the gas company, the city hall and other administrative institutions.
